Terms and Conditions of Publication of Material ("Conditions")
"Us", "we" or "our" means the Australian Medical Publishing Company (ACN 000 005 854) and/or its related bodies corporate publishers of The Medical Journal of Australia (“Journal”).
“Material”’ means all content published including any response, submission, text, photographs, tables, illustrations, images, audio, video, any combination of these or other material.
1. The Agreement and Our rights:
By providing the Material to Us you acknowledge and agree that:
(a) You understand that these Conditions together with the Terms of Access and Use make the complete agreement between you and us (Agreement);
(b) You will comply with the all the terms and conditions of the Agreement;
(c) We reserve the right not to proceed with publication of your Material or to edit or modify the Material as we deem fit and at our absolute discretion.Our decision is final without any notice to you.
(d) You accept complete and total liability arising out of or in connection with your Material, and you indemnify us and any third party against any loss or claim that arises out of or in connection with the Material submitted to us and published, and our vetting, review or publication of the Material in no way diminishes or extinguishes that liability or indemnity.
2. Your Material & Copyright
By uploading, transmitting, posting or otherwise making available Material to Us, you:
(a) grant us a non-exclusive, worldwide, perpetual, royalty free licence to use, reproduce, publish, edit, commercialise and exploit the Material in any way we deem fit (including the right to sublicense);
(b) warrant that you are the author(s) of the Material and/or have the right to grant us the licence referred to above;
(c) warrant that the Material does not infringe the copyright or other rights of any person (including moral rights);
(d) have appropriately acknowledged all other creators /contributors and/or have obtained their consent to grant us the above-mentioned licence; and
(e) unconditionally waive your Moral Rights (as defined by the Copyright Act 1968 (Cth) in the Material.
3. Your conduct
You must not upload, submit, post, transmit or make available Material that is or may be:
(a) illegal, offensive, abusive, indecent, defamatory, violent, obscene, menacing, pornographic;
(b) discriminatory or likely to offend, insult or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability
(c) you know or suspect is false, erroneous, wrong or factually incorrect, or misleading or deceptive;
(d) advertises or promotes goods or services, including those of medical nature, unless approved by us;
(e) endorse or provide testimonial relating to services of health practitioners; or
(f) provide advice of legal, medical, financial or other professional nature.
By providing us with the Material you acknowledge and agree that you have read the entire Agreement between the parties and agree to the terms and conditions contained therein.
